Our bulletin<br \/>\nsummarizing key health sector updates across Canada up to the last<br \/>\nweek of March can be found <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=919112&#038;company_id=21464&#038;redirectaddress=https:\/\/www.fasken.com\/en\/knowledge\/2020\/03\/30-covid19-canadian-health-sector-updates-march-2020\" target=\"_blank\" rel=\"noopener noreferrer\"><br \/>\nhere<\/a>.<\/p>\n<h3>Alberta<\/h3>\n<p>The Alberta Chief Medical Officer of Health has implemented the<br \/>\nfollowing recent measures:<\/p>\n<ul>\n<li>several <a href=\"https:\/\/open.alberta.ca\/dataset\/7c63f693-afc9-4044-a54c-e6d5670567e7\/resource\/88d4baf4-1cfe-4e81-b72e-a5a123ad31ae\/download\/health-cmoh-exemption-addiction-treatment-facilities-2020-03-30.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">exemptions from and clarifications respecting<\/a><br \/>\n(pdf) the application of public health orders to residential<br \/>\naddiction and treatment facilities, issued on <strong>March 30,<br \/>\n2020<\/strong>;<\/li>\n<li>an <a href=\"https:\/\/open.alberta.ca\/dataset\/d703fd54-ee23-4b53-bd4b-480cdbfdd851\/resource\/e853cc79-b3cd-4d31-86cf-c2dfb634904a\/download\/health-cmoh-exemption-isolated-persons-needing-testingcovid-19-2020-04-01.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">exemption<\/a> (pdf) issued on <strong>April 1,<br \/>\n2020<\/strong> from quarantine and isolation orders for individuals<br \/>\nwho require COVID-19 testing or who are required to receive<br \/>\nscheduled critical care that can only be provided in a doctor&#8217;s<br \/>\noffice, hospital or other medical facility, subject to certain<br \/>\nrequirements (including a pre-arranged appointment, private<br \/>\ntransportation where practical and that the doctor&#8217;s office,<br \/>\nhospital or other medical facility is aware of the isolation or<br \/>\nquarantine and is still able to safely provide care). An exemption<br \/>\nis also available for individuals who require emergency care in a<br \/>\nhospital; and<\/li>\n<li>an <a href=\"https:\/\/open.alberta.ca\/dataset\/e9bc11f7-85be-4895-8c66-6b15a650e110\/resource\/cb397114-9c2d-4600-afa1-c41e4c71f19a\/download\/health-cmoh-record-of-decision-cmoh-08-2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) on <strong>April 2, 2020<\/strong><br \/>\nrequiring all operators and service providers of a health care<br \/>\nfacility in Alberta to adhere to prescribed outbreak standards.<br \/>\nThis builds on the expectations of earlier orders. Operators are<br \/>\nrequired to notify public health authorities, residents, families<br \/>\nand staff of COVID-19 cases. Additionally, staff who work at<br \/>\nmultiple facilities must immediately inform their supervisors if<br \/>\nthey have worked or are working at a facility where there is an<br \/>\noutbreak.<\/li>\n<\/ul>\n<p>On <strong>April 2, 2020<\/strong>, <a href=\"https:\/\/docs.assembly.ab.ca\/LADDAR_files\/docs\/bills\/bill\/legislature_30\/session_2\/20200225_bill-010.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Bill 10<\/a> (pdf), the <em>Public Health<br \/>\n(Emergency Powers) Amendment Act, 2020<\/em> received Royal Assent,<br \/>\namending the <em>Public Health Act<\/em> to increase fines and<br \/>\nenforcement powers against persons violating public health<br \/>\norders.<\/p>\n<p>On <strong>April 3, 2020<\/strong>, Alberta released updated <a href=\"https:\/\/open.alberta.ca\/dataset\/a86d7a85-ce89-4e1c-9ec6-d1179674988f\/resource\/76ca9ec0-146d-4f24-be28-a58711343ea5\/download\/covid-19-guideline-2020-04-03-final-v3.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">public health disease management guidelines for<br \/>\nCOVID-19<\/a>(pdf). Also on <strong>April 3, 2020<\/strong>, Alberta<br \/>\nHealth Services <a href=\"https:\/\/www.albertahealthservices.ca\/topics\/Page17001.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">updated its policies<\/a>, providing that no<br \/>\nvisitors will be permitted in long-term care, supportive living,<br \/>\ncongregate living, hospice care and acute care settings in Alberta,<br \/>\nwith exceptions for maternity care, children who are patients, and<br \/>\nvisitors attending to a resident at end-of-life, subject to the<br \/>\nrequirement that the visitor must be feeling well and not have<br \/>\ncertain risk factors (such as being immunocompromised).<\/p>\n<p>The Alberta Emergency Management Agency&#8217;s <a href=\"https:\/\/survey123.arcgis.com\/share\/a9dc59fefa324814884e16f4ac084d6d?utm_source=google&#038;utm_medium=sem&#038;utm_campaign=Covid19&#038;utm_term=bits-and-pieces&#038;utm_content=v3&#038;gclid=CjwKCAjw4KD0BRBUEiwA7MFNTXVpQonW0G5VjZCo3_bGSW35cigB6JRz7g6MHuEFLnuN6clNG-KAQRoC6GUQAvD_BwE\" target=\"_blank\" rel=\"noopener noreferrer\">Bits and Pieces Program<\/a> has been accepting<br \/>\nsubmissions from individuals and organizations that have products<br \/>\nand services to offer in response to COVID-19.<\/p>\n<p><a href=\"https:\/\/www.albertahealthservices.ca\/topics\/Page16944.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Alberta Health Services<\/a> has postponed all<br \/>\nscheduled and elective surgeries, and any diagnostic imaging<br \/>\nprocedures that are considered non-urgent by the ordering<br \/>\nphysician, and is reducing ambulatory clinic services. Physicians<br \/>\nhave been asked to relieve the health system of non-essential and<br \/>\nroutine laboratory testing.<\/p>\n<h3>British Columbia<\/h3>\n<p>The Minister of Public Safety and Solicitor General issued an <a href=\"http:\/\/www.bclaws.ca\/civix\/document\/id\/oic\/OIC_CUR\/m084_2020\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) on <strong>March 26, 2020<\/strong><br \/>\nwhich, among other things, empowered the Minister to:<\/p>\n<ul>\n<li>request that local authorities take<br \/>\nmeasures to identify publicly-owned facilities, such as community<br \/>\ncentres, that can be used for warehousing essential supplies,<br \/>\ntesting and medical care;<\/li>\n<li>request that all retailers, suppliers<br \/>\nand other organizations report their inventory of essential goods<br \/>\nand supplies; and<\/li>\n<li>direct hotel or commercial lodging<br \/>\noperators to provide accommodation for self-isolating individuals<br \/>\nor for supporting essential workers.<\/li>\n<\/ul>\n<p>On <strong>March 31, 2020<\/strong>, the Government of British<br \/>\nColumbia issued an <a href=\"http:\/\/www.bclaws.ca\/civix\/document\/id\/oic\/oic_cur\/0155_2020\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) extending the declaration of a<br \/>\nstate of emergency to April 14, 2020.<\/p>\n<p>On <strong>April 1, 2020<\/strong>, the Province of British<br \/>\nColumbia, the Digital Technology Supercluster and the Business<br \/>\nCouncil of British Columbia <a href=\"https:\/\/news.gov.bc.ca\/releases\/2020PSSG0023-000609\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> (pdf) the COVID-19 Supply Hub, an<br \/>\nonline platform to co-ordinate, source and expedite medical<br \/>\nsupplies and personal protective equipment for provincial health<br \/>\nauthorities. The hub will be used to triage and prioritize offers<br \/>\nand donations.<\/p>\n<p>On <strong>April 2, 2020<\/strong>, the Minister of Public Safety<br \/>\nand Solicitor General issued the <a href=\"http:\/\/www.bclaws.ca\/civix\/document\/id\/oic\/oic_cur\/m094_2020\/search\/CIVIX_DOCUMENT_ROOT_STEM:(COVID)%20AND%20CIVIX_DOCUMENT_ANCESTORS:666551495?3#hit1\" target=\"_blank\" rel=\"noopener noreferrer\">Protection Against Liability (COVID-19)<br \/>\nOrder<\/a>(pdf), effective until the declaration of a state of<br \/>\nemergency (and any extension) expires, which provides that a person<br \/>\nis not liable for damages arising directly or indirectly from an<br \/>\nindividual being infected with or exposed to COVID-19 as a result<br \/>\nof the person providing an essential service if the person was (or<br \/>\nreasonably believed that the person was) providing the service in<br \/>\naccordance with emergency and public health guidance, and was not<br \/>\ngrossly negligent.<sup>2<\/sup><\/p>\n<p>On <strong>April 3, 2020<\/strong>, the Government of British<br \/>\nColumbia updated its <a href=\"https:\/\/www2.gov.bc.ca\/gov\/content\/safety\/emergency-preparedness-response-recovery\/covid-19-provincial-support\/essential-services-covid-19#healthservices\" target=\"_blank\" rel=\"noopener noreferrer\">list of essential services<\/a>.<\/p>\n<p>On <strong>April 3, 2020<\/strong>, the Government of British<br \/>\nColumbia <a href=\"https:\/\/news.gov.bc.ca\/releases\/2020HLTH0121-000628\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that it was partnering with the BC<br \/>\nCare Providers Association to launch EquipCare BC, a program that<br \/>\nwill provide $10 million for infection prevention and control,<br \/>\nquality and safety in long-term care and assisted living homes.<br \/>\nApplications are being accepted as of April 4, 2020.<\/p>\n<p>The BC Centre for Disease Control and the Ministry of Health<br \/>\nhave issued a number of relevant documents, including:<\/p>\n<ul>\n<li>an <a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/health\/about-bc-s-health-care-system\/office-of-the-provincial-health-officer\/covid-19\/duty_to_care_during_covid_march_28_2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ethics analysis<\/a> (pdf) and the <a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/health\/about-bc-s-health-care-system\/office-of-the-provincial-health-officer\/covid-19\/ethics_framework_for_covid_march_28_2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">COVID-19 Ethical Decision-Making Framework<\/a><br \/>\n(pdf) for health care workers on <strong>March 28,<br \/>\n2020<\/strong>;<\/li>\n<li>a <a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/health\/about-bc-s-health-care-system\/office-of-the-provincial-health-officer\/covid-19\/covid-19-pho-guidance-ppe-health-authority-staff.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">bulletin<\/a>(pdf), on <strong>March 29,<br \/>\n2020<\/strong>, on the use of personal protective equipment;<br \/>\nand<\/li>\n<li>the <a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/health\/about-bc-s-health-care-system\/office-of-the-provincial-health-officer\/covid-19\/covid-19-pho-guidance-social-service-providers.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Interim Guidance to Social Service Providers for<br \/>\nthe Prevention and Control of COVID-19 in their Facilities<\/a><br \/>\n(pdf) on <strong>April 4, 2020.<\/strong><\/li>\n<\/ul>\n<p>The Office of Virtual Health, which is part of the Provincial<br \/>\nHealth Services Authority, has created a <a href=\"http:\/\/www.phsa.ca\/health-professionals\/professional-resources\/office-of-virtual-health\/covid-19-virtual-health-toolkit\" target=\"_blank\" rel=\"noopener noreferrer\">COVID-19 Virtual Health Toolkit<\/a>.<\/p>\n<p>A new COVID-19 Strategic Research Advisory Committee has been <a href=\"https:\/\/news.gov.bc.ca\/releases\/2020HLTH0019-000634\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a>, and will be facilitating British<br \/>\nColumbia&#8217;s research efforts.<\/p>\n<h3>Manitoba<\/h3>\n<p>On <strong>March 31, 2020<\/strong>, Manitoba&#8217;s Minister of<br \/>\nHealth, Seniors and Active Living approved a series of <a href=\"https:\/\/manitoba.ca\/asset_library\/en\/proactive\/2019_2020\/orders-soe-03312020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">orders<\/a> (pdf) by the Chief Provincial Public<br \/>\nHealth Officer under <em>The Public Health Act<\/em>. The orders<br \/>\nreplace similar orders made in the days prior, are effective<br \/>\n<strong>April 1, 2020<\/strong> and include:<\/p>\n<ul>\n<li>that all persons are prohibited from<br \/>\nassembling in a public gathering of more than 10 persons, with an<br \/>\nexception for facilities where health care or social services are<br \/>\nprovided;<\/li>\n<li>the closure of non-essential<br \/>\nbusinesses, but nothing in the order prevents health care<br \/>\noperations and services. A number of health care, seniors care and<br \/>\nsocial services are included as essential businesses; and<\/li>\n<li>that physicians, registered nurses,<br \/>\nlicensed practical nurses and midwives may practise their<br \/>\nprofession without restriction. Any other health professional who<br \/>\nis authorized to practise may provide services to, or on behalf of,<br \/>\nthe government, a publicly funded organization or authority, and<br \/>\nany essential business, and may also provide urgent or emergent<br \/>\ncare.<\/li>\n<\/ul>\n<p>On <strong>April 1, 2020<\/strong>, the Minister of Health,<br \/>\nSeniors and Active Living also <a href=\"https:\/\/news.gov.mb.ca\/news\/?archive=&#038;item=47345\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> an order modifying the registration<br \/>\nprocess for former nurses who wish to return to work.<\/p>\n<p>The Government of Manitoba has created a <a href=\"https:\/\/app.smartsheet.com\/b\/form\/e3cd6b9139904951abe87252d83fc6f3\" target=\"_blank\" rel=\"noopener noreferrer\">submission form for businesses<\/a> that are able<br \/>\nto supply products or services to support the province&#8217;s<br \/>\nresponse to COVID-19.<\/p>\n<h3>New Brunswick<\/h3>\n<p>On <strong>April 2, 2020<\/strong>, the Government of New<br \/>\nBrunswick issued a <a href=\"https:\/\/www2.gnb.ca\/content\/dam\/gnb\/Corporate\/pdf\/EmergencyUrgence19.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Renewed and Revised Mandatory Order<\/a>(pdf),<br \/>\nrenewing its declaration of a provincial state of emergency<br \/>\npursuant to the <em>New Brunswick Emergency Measures Act<\/em>.<\/p>\n<p>On <strong>March 30, 2020<\/strong>, the Chief Medical Officer of<br \/>\nHealth published a <a href=\"https:\/\/www2.gnb.ca\/content\/dam\/gnb\/Departments\/h-s\/pdf\/HealthcareSanteIns.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">memo<\/a> (pdf) to Chief Executive Officers of<br \/>\nRegional Health Authorities providing additional restrictions for<br \/>\nvisitors in health care institutions to ensure that vulnerable<br \/>\npatients are protected from COVID-19. Visitors with symptoms of<br \/>\nacute infection should not visit institutions unless essential<br \/>\n(e.g. a parent, guardian or primary caregiver). All visitors who<br \/>\nhave travelled outside of New Brunswick are restricted from<br \/>\nentering a facility for 14 days after they have returned to the<br \/>\nprovince. Family members who are deemed to be the patient or<br \/>\nresident&#8217;s primary caregiver may enter the facility, however<br \/>\nthey must adhere to self-isolation when not in the facility and<br \/>\npractice preventative measures. This also applies to staff who are<br \/>\nsymptomatic of any respiratory illness.<\/p>\n<p>On <strong>March 31, 2020<\/strong>, the Government of New<br \/>\nBrunswick published an <a href=\"https:\/\/www2.gnb.ca\/content\/dam\/gnb\/Departments\/h-s\/pdf\/GuidancePharmacies.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">updated guidance document<\/a> (pdf) for Community<br \/>\nPharmacies in relation to COVID-19. On <strong>April 1,<br \/>\n2020<\/strong>, the government also published an <a href=\"https:\/\/www2.gnb.ca\/content\/dam\/gnb\/Departments\/h-s\/pdf\/homesupport.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">updated guidance document<\/a> (pdf) for Home<br \/>\nSupport Agencies.<\/p>\n<h3>Newfoundland and Labrador<\/h3>\n<p>Effective <strong>April 1, 2020<\/strong>, the Government of<br \/>\nNewfoundland and Labrador issued a <a href=\"https:\/\/www.gov.nl.ca\/covid-19\/files\/Public-Health-Emergency-Extension-Declaration-April-1-2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Public Health Emergency Extension<br \/>\nDeclaration<\/a>(pdf), extending the public health emergency for a<br \/>\nperiod of 14 days.<\/p>\n<p>The government <a href=\"https:\/\/www.gov.nl.ca\/releases\/2020\/health\/0331n04\/\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> on <strong>March 31, 2020<\/strong><br \/>\nthat its Department of Health and Community Services is extending<br \/>\nthe validity period of Medical Care Plan cards to June 30, 2020.<br \/>\nAll cards that would otherwise expire as of March 1, 2020 onward<br \/>\nwill remain valid.<\/p>\n<h3>Northwest Territories<\/h3>\n<p>The Government of Northwest Territories <a href=\"https:\/\/www.gov.nt.ca\/en\/newsroom\/public-health-emergency-renewed-minister-thom\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that, effective <strong>April 1,<br \/>\n2020<\/strong>, the Minister of Health and Social Services extended<br \/>\nthe territory-wide public health emergency for a period of 14 days<br \/>\npursuant to the <em>Northwest Territories Public Health<br \/>\nAct<\/em>.<\/p>\n<h3>Nova Scotia<\/h3>\n<p>On <strong>April 2, 2020<\/strong>, the Government of Nova Scotia<br \/>\ndeclared a <a href=\"https:\/\/novascotia.ca\/coronavirus\/Direction-of-the-Minister-under-a-Declared-State-of-Emergency.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Renewal of Provincial State of Emergency<\/a>(pdf),<br \/>\nextending the state of emergency pursuant to the <em>Emergency<br \/>\nManagement Act<\/em> until noon on April 19, 2020.<\/p>\n<p>The Government of Nova Scotia <a href=\"https:\/\/novascotia.ca\/news\/release\/?id=20200324003\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that it is working to increase<br \/>\ncapacity within the health care sector, including through the<br \/>\nfollowing measures:<\/p>\n<ul>\n<li>increasing testing for COVID-19;<\/li>\n<li>doubling lab capacity to accommodate<br \/>\nincreased testing;<\/li>\n<li>expanding virtual care for<br \/>\nphysicians, nurse practitioners and others so they can offer<br \/>\nappointments to patients through telephone or video;<\/li>\n<li>allowing pharmacists to renew<br \/>\nprescriptions for most medications, with the government covering<br \/>\nthe assessment fee;<\/li>\n<li>College of Physicians and Surgeons of<br \/>\nNova Scotia is waiving the fee for retired doctors to renew their<br \/>\nlicences so they can more easily return to provide services;<\/li>\n<li>the province&#8217;s emergency line has<br \/>\nincreased staff and technology and is now answering 100 percent<br \/>\nmore calls; and<\/li>\n<li>enhancing infection control measures<br \/>\nbeing taken at hospitals, including increasing the frequency of<br \/>\ncleaning and disinfection, focusing on high-risk areas,<br \/>\nhigh-traffic areas and high-touch surfaces, and using stronger<br \/>\ncleaning products.<\/li>\n<\/ul>\n<h3>Nunavut<\/h3>\n<p>Effective <strong>April 2, 2020<\/strong>, Nunavut&#8217;s Minister<br \/>\nof Health issued an <a href=\"https:\/\/gov.nu.ca\/sites\/default\/files\/public_health_act_order_extending_state_of_public_health_emergency.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) extending the state of public<br \/>\nhealth emergency until the end of April 16, 2020.<\/p>\n<p><strong>Ontario<\/strong><\/p>\n<p>On <strong>March 30, 2020<\/strong>, the Government of Ontario <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/200105\" target=\"_blank\" rel=\"noopener noreferrer\">extended<\/a> the Declaration of Emergency pursuant<br \/>\nto the <em>Emergency Management and Civil Protection Act<\/em><br \/>\n(&#8220;EMCPA&#8221;) and associated emergency measures for a period<br \/>\nof 14 days.<\/p>\n<p>On <strong>March 30, 2020<\/strong>, an <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/200095\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> was published, effective <strong>March<br \/>\n27, 2020<\/strong> pursuant to the EMCPA, which expanded the powers<br \/>\navailable to long-term care homes when managing their responses to<br \/>\nCOVID-19. In particular, long-term care homes are authorized to<br \/>\ntake any reasonably necessary measures in accordance with the order<br \/>\nto respond to, prevent and alleviate the outbreak of COVID-19. The<br \/>\norder increases flexibility with respect to:<\/p>\n<ul>\n<li><strong>Reporting<\/strong> &#8211;<br \/>\nlicensees are not required to report any complaints or other<br \/>\ninformation to the Director, other than critical incident reports<br \/>\nand mandatory reports under the <em>Long-Term Care Homes Act,<br \/>\n2007<\/em> (&#8220;LTCHA&#8221;) and O. Reg 79\/10;<\/li>\n<li><strong>Documentation<\/strong> &#8211;<br \/>\ncertain documentation requirements for licensees pursuant to the<br \/>\nLTCHA are removed or relaxed;<\/li>\n<li><strong>Staffing<\/strong> &#8211; licensees<br \/>\nmay fill any staff position with a person who has the adequate<br \/>\nskills, training and knowledge, and are not required to (i) ensure<br \/>\nthat the minimum number of staffing hours set out in the LTCHA and<br \/>\nO. Reg 79\/10 are met for a position (provided certain requirements<br \/>\nare met), (ii) meet the screening measures set out in the LTCHA and<br \/>\nO. Reg 79\/10 (provided other measures are adopted to ensure<br \/>\nresident care and safety), or (iii) meet the training and<br \/>\norientation requirements set out in the LTCHA and O. Reg 79\/10<br \/>\n(provided that they ensure staff and volunteers take measures to<br \/>\nensure resident care and safety);<\/li>\n<li><strong>Care Requirements<\/strong><br \/>\n<strong>&#8211;<\/strong> licensees are not required to (i) hold care<br \/>\nconferences at intervals set out in O. Reg 79\/10 (provided that<br \/>\nthey ensure care conferences take place based on the clinical needs<br \/>\nof the resident) or (ii) ensure that a physical examination of a<br \/>\nresident occurs annually, but they must ensure that a physical<br \/>\nexamination occurs within a reasonable period of time after the<br \/>\nresident&#8217;s last examination;<\/li>\n<li><strong>Admission, Transfers and<br \/>\nDischarges<\/strong> &#8211; licensees may use flexible processes for the<br \/>\nadmission, transfer and discharge of persons (but nothing derogates<br \/>\nfrom the requirements under the LTCHA to seek consent from such<br \/>\npersons);<\/li>\n<li><strong>Licensing\/Management<br \/>\nContracts<\/strong> &#8211; licensees are not required to follow all steps<br \/>\nunder the LTCHA and O. Reg 79\/10 when seeking approval from the<br \/>\nDirector to obtain a licence or management contract under the LTCHA<br \/>\n(unless otherwise required); and<\/li>\n<li><strong>Administration of<br \/>\nDrugs<\/strong> &#8211; licensees may adopt flexible practices related to<br \/>\nthe administration of drugs to residents (provided that the<br \/>\npractices are within the scope of practice of the administrator of<br \/>\nthe drug).<\/li>\n<\/ul>\n<p>On <strong>April 2, 2020<\/strong>, the Province of Ontario<br \/>\nissued two orders under the EMCPA: the first <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/r20116\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> in relation to work deployment and<br \/>\nstaffing measures in every board of health within the meaning of<br \/>\nthe <em>Health Protection and Promotion Act<\/em>, and the second <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/200118\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> in relation to deployment of staff in<br \/>\nevery retirement home under the <em>Retirement Homes Act,<br \/>\n2010<\/em>. Pursuant to each order, boards of health and licensees<br \/>\nof retirement homes, respectively, shall and are authorized to<br \/>\ntake, with respect to work deployment and staffing, any reasonably<br \/>\nnecessary measure to respond to, prevent and alleviate the outbreak<br \/>\nof COVID-19 despite any other statute, regulation, order,<br \/>\narrangement or agreement (including a collective agreement).<\/p>\n<p>The orders require and authorize boards of health and licensees<br \/>\nof retirement homes, respectively, to take the following<br \/>\nmeasures:<\/p>\n<ul>\n<li>identifying staffing priorities and<br \/>\ndeveloping, modifying and implementing redeployment plans,<br \/>\nincluding the following: <\/p>\n<ul type=\"circle\">\n<li>redeploying staff within different<br \/>\nlocations in (or between) facilities;<\/li>\n<li>changing the assignment of work and<br \/>\nthe scheduling of work or shift assignments;<\/li>\n<li>deferring or cancelling vacations,<br \/>\nabsences or other leaves;<\/li>\n<li>employing extra part-time or<br \/>\ntemporary staff or contractors;<\/li>\n<li>using volunteers to perform work;<br \/>\nand<\/li>\n<li>providing appropriate training or<br \/>\neducation as needed to staff and volunteers;<\/li>\n<\/ul>\n<\/li>\n<li>requiring and collecting information<br \/>\nfrom staff, contractors or volunteers about their availability to<br \/>\nprovide services for the board of health or licensee, as<br \/>\napplicable;<\/li>\n<li>requiring and collecting information<br \/>\nfrom staff, contractors or volunteers about their likely or actual<br \/>\nexposure to COVID-19, or about any other health conditions that may<br \/>\naffect their ability to provide services;<\/li>\n<li>cancelling or postponing services (or<br \/>\ninterdisciplinary care conferences in the case of retirement homes)<br \/>\nthat are not related to responding to, preventing or alleviating<br \/>\nthe outbreak of COVID-19 or services that are not deemed to be<br \/>\ncritical; and<\/li>\n<li>suspending any grievance process with<br \/>\nrespect to any matter referred to in the order.<\/li>\n<\/ul>\n<p>Additionally, the second order also requires and authorizes<br \/>\nlicensees of retirement homes to suspend (i) required staff<br \/>\nscreening measures (including a police record check) if other<br \/>\nscreening measures that ensure the care and safety of residents are<br \/>\nconducted, and (ii) any requirement to document or post new<br \/>\ninformation, except for requirements to document an incident of a<br \/>\nsignificant nature or where documentation is required to ensure the<br \/>\nproper care and safety of a resident. Licensees are also required<br \/>\nand authorized to conduct any skills and experience inventories of<br \/>\nstaff to identify possible alternative roles in priority areas.<br \/>\nFurther, licensees are required to report an outbreak of COVID-19<br \/>\nto the Retirement Homes Regulatory Authority on the same day that<br \/>\nthe outbreak is reported to the local medical officer of health or<br \/>\ndesignate under subsection 27(5) of O. Reg 166\/11 made under the<br \/>\n<em>Retirement Homes Act, 2010.<\/em><\/p>\n<p>On <strong>March 30, 2020<\/strong>, the government <a href=\"https:\/\/news.ontario.ca\/mohltc\/en\/2020\/03\/ontario-increasing-health-and-safety-measures-to-better-protect-frontline-nurses-from-covid-19.html\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that the Province of Ontario and the<br \/>\nChief Medical Officer, in consultation with the Ontario Nurses&#8217;<br \/>\nAssociation, Ontario Health and the Ontario Hospital Association,<br \/>\nare issuing a directive on health and safety standards for<br \/>\nfrontline nurses in hospitals to prevent exposure to and<br \/>\ntransmission of COVID-19. The <a href=\"http:\/\/www.health.gov.on.ca\/en\/pro\/programs\/publichealth\/coronavirus\/docs\/COVID_19_joint_statement.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">directive<\/a> (pdf) outlines:<\/p>\n<ul>\n<li>precautions for interactions with<br \/>\nsuspected, presumed or confirmed COVID-19 patients;<\/li>\n<li>point-of-care risk assessments for<br \/>\nevery patient interaction to assess appropriate health and safety<br \/>\nmeasures; and<\/li>\n<li>training on safe use of all personal<br \/>\nprotective equipment.<\/li>\n<\/ul>\n<p>Additionally, the Government of Ontario introduced the following<br \/>\nlegislative and regulatory changes over the past week which are<br \/>\nrelevant to responding to COVID-19:<\/p>\n<p><em>Connecting Care Act, 2019<\/em><\/p>\n<p>On <strong>April 1, 2020<\/strong>, the government <a href=\"http:\/\/www.health.gov.on.ca\/en\/news\/connectedcare\/2020\/CC_20200104.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that the transfer order to move the<br \/>\nOntario Telemedicine Network (&#8220;OTN&#8221;) into Ontario Health<br \/>\ncame into effect. The transfer order was first issued on March 18,<br \/>\n2020 by the Deputy Premier and Minister of Health under the<br \/>\n<em>Connecting Care Act, 2019<\/em>. The announcement indicated that<br \/>\nwork locations and reporting obligations for OTN will remain the<br \/>\nsame. The government stated that this transfer helps further pave<br \/>\nthe way for digital-first approaches to health care in Ontario,<br \/>\nincluding virtual care and improving the integration and efficiency<br \/>\nof digital assets across the health system.<\/p>\n<p>The announcement indicated that, based on guidance from Ontario<br \/>\nHealth, the transfer of health system funding, planning and<br \/>\ncoordination functions of the Local Health Integration Networks<br \/>\n(&#8220;LHIN&#8221;) will be postponed as Ontario continues to<br \/>\nactively respond to COVID-19. Plans will be made to transfer LHIN<br \/>\nfunctions into Ontario Health at a later date.<\/p>\n<p><em>Ontario Drug Benefit Act and Drug Interchangeability and<br \/>\nDispensing Fee Act<\/em><\/p>\n<p>To respond to the possibility of drug shortages in the province<br \/>\ncaused by COVID-19, Ontario <a href=\"https:\/\/www.ontariocanada.com\/registry\/view.do?postingId=32067&#038;language=en\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that its Ministry of Health is<br \/>\nproposing to change the effective date of regulatory amendments<br \/>\nmade to <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/960201\" target=\"_blank\" rel=\"noopener noreferrer\">O. Reg 201\/96<\/a> under the Ontario Drug Benefit<br \/>\nAct (&#8220;ODBA&#8221;), and to <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/900935\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation 935<\/a> under the Drug<br \/>\nInterchangeability and Dispensing Fee Act (&#8220;DIDFA&#8221;). This<br \/>\nchange will allow private label products (&#8220;PLPs&#8221;) to be<br \/>\ndesignated as listed drug products under the ODBA and as<br \/>\ninterchangeable products under the DIDFA on <strong>April 1,<br \/>\n2020<\/strong>, rather than on July 1, 2020. Accelerating the<br \/>\ncommencement date of the PLP changes will make PLPs eligible for<br \/>\npublic funding under the Ontario Drug Benefit Program, and make it<br \/>\neasier for pharmacies to sell PLPs to private and retail customers,<br \/>\nat an earlier point in time.<\/p>\n<p>Further, the province <a href=\"https:\/\/www.ontariocanada.com\/registry\/view.do?postingId=32087&#038;language=en\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> that its Ministry of Health is<br \/>\nproposing regulatory amendments to <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/960201\" target=\"_blank\" rel=\"noopener noreferrer\">O. Reg 201\/96<\/a> under the ODBA to align<br \/>\nOntario&#8217;s rules for determining brand reference prices with the<br \/>\nnational approach used by the Pan-Canadian Pharmaceutical Alliance.<br \/>\nThese changes will remove certain barriers related to the listing<br \/>\nof some generic drug products on the Ontario Drug Benefit<br \/>\nFormulary, which is expected to improve the pharmaceutical supply<br \/>\nchain to offset the possibility of drug shortages in the province<br \/>\ndue to COVID-19. The proposed effective date of these regulatory<br \/>\nchanges is <strong>April 1, 2020<\/strong>.<\/p>\n<h3>Prince Edward Island<\/h3>\n<p>On <strong>March 31, 2020<\/strong>, a <a href=\"https:\/\/www.princeedwardisland.ca\/sites\/default\/files\/publications\/20200401130341726.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Public Health Order<\/a> (pdf) was issued, to be in<br \/>\neffect for 30 days, which orders:<\/p>\n<ul>\n<li>health care workers to self-isolate<br \/>\nas follows: <\/p>\n<ul type=\"circle\">\n<li>if diagnosed with COVID-19, until<br \/>\nthey receive two negative test results (24 hours apart) and are<br \/>\ncleared by a public health official; and<\/li>\n<li>if symptomatic and awaiting the<br \/>\nresults of a test for COVID-19, until a negative test result is<br \/>\nreceived;<\/li>\n<\/ul>\n<\/li>\n<li>the closure of non-essential<br \/>\nservices, including: <\/p>\n<ul type=\"circle\">\n<li>regulated health professionals,<br \/>\nunless the services to be provided are to address essential health<br \/>\ncare or an emergency health care situation. Virtual care for<br \/>\nnon-emergency\/elective care services is permitted if professionals<br \/>\nare authorized to provide this care within their scope of practice<br \/>\nand by their governing college; and<\/li>\n<li>unregulated health care providers,<br \/>\nwith the exception of those that are providing direct support to<br \/>\nregulated health care providers in essential health care or an<br \/>\nemergency health care situation; and<\/li>\n<\/ul>\n<\/li>\n<li>visitations to nursing homes and<br \/>\ncommunity care facilities are prohibited, unless for exceptional<br \/>\ncircumstances including end-of-life.<\/li>\n<\/ul>\n<h3>Quebec<\/h3>\n<p>As noted in last week&#8217;s bulletin, on <strong>March 29,<br \/>\n2020<\/strong>, the Government of Quebec made an <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/decret-388-2020-anglais.pdf?1585512705\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) extending the public health<br \/>\nemergency until April 7, 2020. This order also extended prior<br \/>\norders to the same date.<\/p>\n<p>On <strong>March 30, 2020<\/strong>, the Minister of Health and<br \/>\nSocial Services made an <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/AM_numero_2020-012_anglais.pdf?1585617584\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) requiring all retail commercial<br \/>\nestablishments to be closed on Sundays. Pharmacies are exempted<br \/>\nfrom the order.<sup>3<\/sup> The order also allows pharmacies and<br \/>\nstores offering pharmacy services to extend their hours of<br \/>\noperation in order to meet demand. On <strong>April 4,<br \/>\n2020<\/strong>, an <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/AM_numero_2020-015-anglais.pdf?1586042123\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) was made adding pharmacies not in<br \/>\nmalls, for online or telephone orders and for delivery of<br \/>\nmedications and pharmaceutical, hygienic and sanitary products.<\/p>\n<p>On <strong>April 1, 2020<\/strong>, the Minister of Health and<br \/>\nSocial Services made an <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/AM_numero_2020-013-anglais.pdf?1585753157\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) restricting access to several<br \/>\nhealth regions in the Province of Quebec, notably<br \/>\nSaguenay-Lac-Saint-Jean, Nunavik and Gasp\u00e9sie. Access to<br \/>\nthese regions is permitted for certain persons, including persons<br \/>\nworking in a priority service, persons whose travel is necessary to<br \/>\nobtain care or services required by their state of health or to<br \/>\nprovide such care or services to a person requiring them, and<br \/>\npersons whose travel is necessary for humanitarian purposes.<br \/>\nAdditional territories were added by an <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/AM_numero_2020-015-anglais.pdf?1586042123\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) on <strong>April 4,<br \/>\n2020<\/strong>.<\/p>\n<p>On <strong>April 3, 2020<\/strong>, the College of Physicians of<br \/>\nQuebec and the Professional Order of Physiotherapy of Quebec <a href=\"http:\/\/www.cmq.org\/page\/fr\/covid-19-les-physiotherapeutes-pourront-effectuer-le-test-de-depistage.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> (in French only) an agreement to<br \/>\nallow physiotherapists to perform COVID-19 screening tests after<br \/>\ncompleting short training.<\/p>\n<p>On <strong>April 4, 2020<\/strong>, the Minister of Health and<br \/>\nSocial Services made an <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/AM_numero_2020-015-anglais.pdf?1586042123\" target=\"_blank\" rel=\"noopener noreferrer\">order<\/a> (pdf) modifying previous orders<br \/>\naffecting collective agreements in the health and social services<br \/>\nnetwork to implement measures including the following:<\/p>\n<ul>\n<li>requiring salaried persons who cannot<br \/>\nwork because of health risks or an isolation order to be<br \/>\nremunerated as if they were at work;<\/li>\n<li>providing that a salaried person who<br \/>\nworks in one of the work environments listed below receive an 8%<br \/>\nbonus for the hours worked in that environment: <\/p>\n<ul type=\"circle\">\n<li>emergency units (except psychiatric<br \/>\nemergencies);<\/li>\n<li>intensive care units with at least<br \/>\none diagnosed case of COVID-19;<\/li>\n<li>clinics (screening and evaluation)<br \/>\nspecific to COVID-19;<\/li>\n<li>units reserved for patients with a<br \/>\npositive COVID-19 diagnosis;<\/li>\n<li>units in a residential and long-term<br \/>\ncare centre;<\/li>\n<li>other residential units, if at least<br \/>\none diagnosed case of COVID-19 is confirmed; and<\/li>\n<li>pneumology units; and<\/li>\n<\/ul>\n<\/li>\n<li>that intermediate officers and<br \/>\nambulance technicians are to receive a bonus of 4% for hours<br \/>\nworked.<\/li>\n<\/ul>\n<p>On <strong>April 5, 2020<\/strong>, the Premier of Quebec <a href=\"https:\/\/www.quebec.ca\/en\/premier\/actualites\/detail\/le-quebec-sur-pause-jusqu-au-4-mai-annonce-francois-legault\/\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> (in French only) that the lockdown<br \/>\nof non-essential services will be extended from April 13, 2020 to<br \/>\nMay 4, 2020.<\/p>\n<h3>Saskatchewan<\/h3>\n<p>The most recent public health order issued in the Province of<br \/>\nSaskatchewan was on March 26, 2020, as reported <a href=\"https:\/\/www.fasken.com\/en\/knowledge\/2020\/03\/30-covid19-canadian-health-sector-updates-march-2020\" target=\"_blank\" rel=\"noopener noreferrer\">in last week&#8217;s bulletin<\/a>. On <strong>April<br \/>\n1, 2020<\/strong>, the Deputy Minister of Health sent a <a href=\"https:\/\/www.saskatchewan.ca\/government\/health-care-administration-and-provider-resources\/treatment-procedures-and-guidelines\/emerging-public-health-issues\/2019-novel-coronavirus\/public-health-measures\/guidance-for-health-care-facilities\" target=\"_blank\" rel=\"noopener noreferrer\">letter<\/a> to the Saskatchewan Health Authority,<br \/>\noutlining how the restrictions apply to long-term care. The<br \/>\nSaskatchewan Health Authority has also prepared <a href=\"https:\/\/www.saskatchewan.ca\/government\/health-care-administration-and-provider-resources\/treatment-procedures-and-guidelines\/emerging-public-health-issues\/2019-novel-coronavirus\/public-health-measures\/guidance-for-health-care-facilities\" target=\"_blank\" rel=\"noopener noreferrer\">standards and tools<\/a> with respect to visitors<br \/>\nfor continuing care services.<\/p>\n<p>On <strong>March 30, 2020<\/strong>, the Saskatchewan Health<br \/>\nAuthority published <a href=\"https:\/\/www.saskhealthauthority.ca\/news\/releases\/Pages\/2020\/March\/Guidelines-for-donations-to-SHA-established.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">guidelines<\/a> for donations of supplies.<\/p>\n<p>In Saskatchewan, the <a href=\"https:\/\/www.saskatchewan.ca\/government\/news-and-media\/2020\/april\/03\/covid-19-update-april-3\" target=\"_blank\" rel=\"noopener noreferrer\">Ministry of Health<\/a> has been working with<br \/>\nprofessional health bodies to provide temporary licences for<br \/>\nretired, non-practising and student members, and the Government of<br \/>\nSaskatchewan is covering the fees for these professionals.<\/p>\n<h3>Yukon<\/h3>\n<p>As of <strong>March 27, 2020<\/strong>, Yukon&#8217;s Chief Medical<br \/>\nOfficer of Health ordered the territory&#8217;s dental practices to<br \/>\nsuspend all non-urgent treatment until further notice.<\/p>\n<h3>Federal<\/h3>\n<p>On <strong>April 1, 2020<\/strong>, a <a href=\"http:\/\/canadagazette.gc.ca\/rp-pr\/p2\/2020\/2020-04-01\/html\/sor-dors53-eng.html\" target=\"_blank\" rel=\"noopener noreferrer\">regulation<\/a> was published in the Canada<br \/>\nGazette, adding COVID-19 to the Schedule of reportable illnesses<br \/>\nunder the <em>Quarantine Act.<\/em> Travellers and conveyance<br \/>\noperators must notify authorities of any suspected or confirmed<br \/>\nstatus, or exposure to the disease.
